These Terms of Service ("Terms") govern your access to and use of the website at rent4029.com, our online leasing and rental application tools, our identity verification tools, our text-message and email communications, and our related online services (together, the "Services"), which are provided by Alder Investments, LLC ("Alder Investments," "we," "us," or "our"), the owner and operator of the 4029 Rainier Ave Apartments community located at 4029 Rainier Ave S, Seattle, WA 98118.

Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Services.

1. Eligibility and Acceptance

You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent that you meet these requirements and that any information you provide is accurate, current, and complete. If you use the Services on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf.

2. The Services

The Services provide information about the 4029 Rainier Ave Apartments community and let you contact us, schedule tours, submit a rental application, complete identity verification, sign documents electronically, and receive related communications. The Services are provided for prospective and current residents and other authorized visitors. We may add, change, suspend, or discontinue any part of the Services at any time without notice.

4. Inquiries, Tours, Applications, and Screening

Submitting an inquiry, booking a tour, or submitting a rental application does not create a lease, a reservation, or any obligation on our part to rent a unit to you. Unit availability, pricing, specials, and other details shown through the Services are subject to change and may contain errors; nothing on the Services is an offer or a guarantee of availability, pricing, approval, or a specific unit. A tenancy is created only by a written lease signed by you and by us.

Rental applications are subject to our rental criteria and to background screening as described in our Privacy Policy. We use a third-party tenant screening company to obtain consumer reports, and we request your authorization before doing so. If we take an adverse action based in whole or in part on a consumer report, we will provide the notices required by law. Application fees, if any, are disclosed before you pay them.

We are an equal housing opportunity provider. We do not discriminate against any person because of race, color, religion, national origin, sex, familial status, disability, or any other basis protected by applicable federal, state, or local fair housing laws, including the Washington Law Against Discrimination and applicable Seattle ordinances.

6. Electronic Communications and Text Messaging

By providing your email address or phone number and using the Services, you consent to receive electronic communications from us related to your inquiry, tour, application, or tenancy, including transactional messages such as confirmations, reminders, and follow-ups. These communications are part of your relationship with us.

Text messaging (SMS). If you provide a mobile phone number, you consent to receive text messages from us about your inquiry, tour, or application. Message frequency varies, and message and data rates may apply. You can opt out of text messages at any time by replying STOP, and reply HELP for help. We do not sell your mobile phone number, and we will not share your mobile number or your SMS/text-messaging opt-in and consent data with any third parties or affiliates for their own marketing or promotional purposes; we share it only with the service providers that help us deliver these messages on our behalf. Consent to receive text messages is not a condition of applying for or renting a unit. Additional details are in our Privacy Policy.

7. Identity Verification

Some Services include automated identity verification, which may require you to provide a photo of a government-issued ID and a photo of yourself. If you prefer not to complete automated identity verification, please contact our office to discuss alternatives. How we handle images and related data is described in our Privacy Policy.

8. Fees and Payments

Any application fees, holding fees, deposits, rent, or other charges will be disclosed to you before you are asked to pay them and are governed by these Terms, your application, and, once signed, your lease. Payments may be processed by third-party payment processors or person-to-person payment services under their own terms and privacy practices. Except as required by law or as expressly stated at the time of payment, fees are non-refundable.

9. Intellectual Property

The Services and their content — including text, graphics, logos, images, photographs, page layouts, and software — are owned by or licensed to Alder Investments and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use in connection with a genuine interest in the community. You may not otherwise copy, modify, distribute, sell, or create derivative works from the Services without our prior written consent. All trademarks and service marks displayed are the property of their respective owners.

10. Information You Submit

You are responsible for the accuracy of the information you submit through the Services, and you represent that you have the right to submit it. You retain ownership of the information you provide, and you grant us a license to use it as necessary to provide the Services, evaluate your inquiry or application, and operate our business, consistent with our Privacy Policy. Do not submit information about anyone else unless you are authorized to do so.

11. Third-Party Services and Links

The Services may include links to, or integrations with, third-party websites and services that we do not own or control, such as maps, social media, screening providers, and payment processors. We are not responsible for the content, products, services, or practices of those third parties, and your use of them is governed by their own terms and privacy policies. Links do not imply our endorsement.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY INFORMATION (INCLUDING UNIT AVAILABILITY AND PRICING) IS COMPLETE, ACCURATE, OR CURRENT. TO THE EXTENT ANY WARRANTY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, IT IS LIMITED TO THE MINIMUM PERIOD AND EXTENT REQUIRED BY LAW.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALDER INVESTMENTS AND ITS OWNERS, AFFILIATES, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND THESE LIMITS DO NOT APPLY TO OUR OBLIGATIONS UNDER A SIGNED LEASE OR UNDER LANDLORD-TENANT LAW.

14. Indemnification

You agree to indemnify and hold harmless Alder Investments and its owners, affiliates, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Services or these Terms will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts, except that either party may seek relief in small claims court where available. Nothing in this section affects any rights or remedies you may have under a signed lease or under applicable landlord-tenant or consumer-protection law.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Changes are effective when posted. Your continued use of the Services after an update means you accept the updated Terms. If you do not agree to a change, please stop using the Services.

17. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or misused the Services. The sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.
